By accessing or using Daily Grind, you agree to these Terms.
1. Daily Grind
Daily Grind is a daily planning, task, routine, habit, and productivity tool designed to help users organize and keep track of everyday activities.
Features may include daily worksheets, tasks, priorities, notes, routines, self-care tracking, activity tracking, focus tools, historical information, personalized briefings, integrations, and accountability features.
Features may change as Daily Grind develops.
2. Eligibility
You must be at least 13 years old to use Daily Grind.
If you are under the age of majority where you live, you may use Daily Grind only with the permission of a parent or legal guardian where required.
3. Accounts
Certain features may require an account.
You agree to:
- Provide accurate account information
- Keep your account credentials secure
- Notify us if you believe your account has been compromised
- Take responsibility for activity conducted through your account
You may not use another person's account without authorization.
4. Your Content
You retain ownership of the tasks, notes, entries, and other content you create in Daily Grind.
You give Daily Grind a limited right to store, process, transmit, and display your content only as reasonably necessary to operate, secure, improve, and provide the Service and features you request.
This permission ends when the information is deleted from our systems, subject to reasonable backup retention and legal obligations.
5. AI and Intelligent Features
Daily Grind may provide AI-assisted features such as briefings, summaries, suggestions, prioritization assistance, or contextual recommendations.
AI-generated information may be incomplete, inaccurate, or inappropriate for your circumstances.
You are responsible for reviewing AI-generated information before relying on it.
Daily Grind's AI features are not a substitute for professional medical, psychological, legal, financial, or other expert advice.
Do not rely on Daily Grind for emergency decisions or situations involving immediate risk to health or safety.
6. Health, Wellness, and Productivity Information
Daily Grind may allow users to track habits, self-care, physical activity, food, water, routines, or other wellness-related information.
Daily Grind is not a medical service.
It does not diagnose, prevent, treat, or cure medical or psychological conditions and is not a substitute for professional healthcare.
No particular productivity, health, behavioral, or habit outcome is guaranteed.
7. Optional Integrations
Daily Grind may allow you to connect third-party services, such as calendars, email services, health or fitness services, or other applications.
Your use of those services may also be governed by their own terms and privacy policies.
You are responsible for the permissions you grant to connected services.
Daily Grind is not responsible for the availability, accuracy, security, or operation of third-party services outside our control.
8. Friends, Challenges, and Sharing
Daily Grind may offer optional friend, accountability, or challenge features.
If you use these features:
- You are responsible for the information you choose to share
- You must respect other users and their privacy
- You may not harass, threaten, impersonate, exploit, or abuse another user
- You may not use Daily Grind to distribute unlawful, harmful, or infringing content
- You may not attempt to bypass another user's privacy or visibility settings
Daily Grind may remove content, restrict features, block accounts, or take other reasonable action where necessary to address abuse, safety concerns, or violations of these Terms.
Where reporting or blocking tools are available, users are expected to use them appropriately.
9. Acceptable Use
You may not:
- Use Daily Grind for unlawful purposes
- Attempt to gain unauthorized access to accounts, systems, or data
- Interfere with or disrupt the Service
- Circumvent security protections
- Introduce malicious code
- Scrape or systematically extract data without authorization
- Reverse engineer the Service except where applicable law expressly permits it
- Use the Service to violate another person's privacy, intellectual property, or other rights
- Misrepresent your identity or affiliation with another person or organization
10. Subscriptions and Purchases
Daily Grind may offer optional paid subscriptions or other purchases.
For purchases made through Apple's App Store:
- Payment is processed by Apple
- Available plans, durations, and prices are displayed before purchase
- Auto-renewable subscriptions renew unless canceled in accordance with Apple's subscription settings
- You may manage or cancel subscriptions through your Apple Account
- Refunds are handled according to Apple's applicable policies
Canceling a subscription does not necessarily delete your Daily Grind account.
Account deletion and subscription cancellation are separate actions.
Where applicable, these Terms supplement the license terms governing apps distributed through the Apple App Store.
11. Beta and Pre-Release Features
Some Daily Grind features may be offered in beta, testing, preview, or pre-release form.
These features may:
- Change substantially
- Contain bugs or errors
- Be temporarily unavailable
- Be discontinued
- Produce unexpected results
Do not rely on Daily Grind as the sole record of information that is critical, irreplaceable, or time-sensitive.
12. Intellectual Property
Daily Grind, including its software, source code, visual design, branding, graphics, website content, and original features, is owned by Daily Grind Mobile or its licensors and is protected by applicable intellectual property laws.
These Terms do not transfer ownership of Daily Grind's intellectual property to you.
You may not copy, reproduce, distribute, sell, license, or commercially exploit Daily Grind or its proprietary materials except as expressly permitted by us or applicable law.
Your ownership of content you create within Daily Grind is addressed separately in Section 4.
13. Availability and Changes
We may modify, improve, add, remove, suspend, or discontinue features of Daily Grind.
We do not guarantee that every feature will always be available or operate without interruption.
We may perform maintenance or make technical changes that temporarily affect availability.
14. No Guarantee of Results
Daily Grind is a tool.
We do not guarantee:
- Increased productivity
- Completion of tasks
- Achievement of goals
- Habit formation
- Particular health or wellness outcomes
- That reminders or notifications will always be delivered
- That AI-generated suggestions will be accurate
Your results depend on many factors outside our control.
15. Disclaimer of Warranties
To the extent permitted by law, Daily Grind is provided on an "as is" and "as available" basis.
We do not guarantee that the Service will be uninterrupted, error-free, completely secure, or suitable for every purpose.
Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you.
16. Limitation of Liability
To the maximum extent permitted by applicable law, Daily Grind Mobile will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, Daily Grind.
This may include losses resulting from missed tasks, reminders, appointments, lost data, reliance on AI-generated information, third-party services, or interruption of the Service.
To the extent permitted by law, our aggregate liability arising from the Service will not exceed the amount you paid to Daily Grind during the twelve months preceding the event giving rise to the claim.
Nothing in these Terms excludes liability that cannot legally be excluded.
17. Suspension and Termination
We may suspend or terminate access to Daily Grind when reasonably necessary because of:
- A violation of these Terms
- Fraud or unlawful activity
- Abuse of another user
- Security threats
- Attempts to interfere with the Service
- Legal or regulatory requirements
You may stop using Daily Grind at any time.
Where account deletion is available, you may request deletion through the applicable account controls or by contacting support.
18. Governing Law
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.
Any dispute that is permitted to be brought in court will be subject to the jurisdiction of the appropriate courts located in New York, unless applicable law provides otherwise.
19. Changes to These Terms
We may update these Terms as Daily Grind changes.
If a change is material, we may provide notice through the app, website, email, or another appropriate method.
Continued use of Daily Grind after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.
